A woman living in a small cottage in a nice suburb of a big city, faced a conflict with a man who had built an illegal mesh fence to block the pathway through a field. This led to her and the cottagers cutting the fence to make a passage, resulting in accusations of theft and communism from the man.
Tiny Cottage Living
In a small cottage settlement located in a nice suburb of a big city, a woman, who was 22 years old, and her husband lived in a tiny summer house, which had become quite a common thing in their country due to the high cost of housing.
Greed and Houses
Next to the settlement, there was a field owned by a man who lived in a big family house adjacent to the field. The man had been trying for decades to persuade the city to change the type of land in the zoning plan so that he could build houses on the field and make a lot of money.
A Field of Natural Beauty
However, the field was next to a forest, and the city did not want to allow him to build there and destroy the urban greenery. As a result, the man had become known for doing petty things to the cottagers, such as digging up pathways when he plowed the soil.
His latest action was to build an illegal mesh fence to block the pathway through the field, which meant that the cottagers, including the woman’s elderly neighbors, had to travel 10+ minutes longer to get to their houses. In their country, there was a law about free passage through the countryside, which meant that you couldn’t fence your field unless you had permission.
The Mayor’s On the Case
They knew he built the fence illegally because it was discussed in their district’s Facebook page, and their mayor confirmed that she was trying to make him remove the fence. However, the authorities were extremely slow in such cases.
A Good Solution
The woman tried to agree on a solution with the man by offering to pay him for the extra mesh fence he would need so that he would leave out the pathway from the fenced area. However, the man laughed at her and claimed that he wasn’t doing anything illegal.
Taking Matters into their Own Hands
The woman and the cottagers decided to cut the man’s illegal fence to make a passage as it was before, so they could walk their dog there, and their elderly neighbors could get to the road. They weren’t the only ones who planned on doing it, and when they arrived, they found out that it was already cut. They cut it again, and then someone else did the same.
He Gave Up
The man stopped trying, so the passage remained there. He couldn’t report it because it would point out that he had built an illegal fence, but he started calling the cottagers communists who were trying to steal his property.
Was She the Jerk?
The woman wondered if she and the cottagers were justified in this conflict and asked if she was the jerk. She explained the legalities in the comments, saying that there was no easement, but in her country, there was a kind of “easement” at all fields/forest/meadow properties. By fencing the field, the man was using the land in an unauthorized manner.
No Easement Granted
“In the municipal zoning plan, the field was listed as an area for recreation. His obligation to allow passage wasn’t explicitly listed in some kind of easement, but he had this obligation to the public as a whole. The condition of owning this type of land was to let people walk on it and to grow agricultural crops there.” The woman explained.
That’s why it was currently quite cheap, and it would be 20+ times more expensive if it was the type of land where you could build houses and fence it off. The man wanted to change the type of land so he could build houses and make a lot of money.
The woman believed that she and the cottagers were justified in cutting the man’s illegal fence to make a passage. She said, “We had no other choice. He was blocking our way, and he was doing it illegally. We tried to reason with him, but he laughed at us. We had to take matters into our own hands and cut the fence. We weren’t stealing his property; we were just trying to use our right to free passage through the countryside.”
Controversial But Necessary
The woman’s actions may have been seen as controversial, but she believed that she was standing up for what was right. She and the cottagers were not going to let the man take advantage of them and block their way illegally. They were going to fight for their rights and not back down.
The Internet Responded
This commenter wrote, “He must be a very sad man. Anyway, I’m going with a slight jerk, since he’s not allowed to build a fence. If I were in your shoes, I’d have sent him an ultimatum, before cutting anything: if he doesn’t put down the fence, you would call the police.”
More Internet Responses
Another person posted, “Your neighbor is legally and morally in the wrong. I think the person in the comments relating it to an easement is spot on. You can’t prevent people from accessing their property. I used to own a house that shared a driveway with another house.”
