A woman and her wife had recently acquired her aunt and uncle’s old home, with plans to renovate and prepare it for their soon-to-be-adopted child. Their renovation plans included assembling a fence between their yard and their neighbors’, but they would soon find out that this was not a popular decision.
The woman’s aunt and uncle had previously allowed the kids from the neighboring house to play in their garden. However, even after the aunt and uncle had moved out, the practice continued. However, the women had future plans for their garden, including installing a shed and preparing for their own child’s arrival.
One day, the woman went outside to plan out a yard fence. “I was measuring the property lines when the man from next door came out and asked what I was doing”, she explained. “I told him about the fence, and asked when would be best for me to do it.”
Not on Board
However, the neighbor was not on board with the idea of a fence. He mentioned that they had a baby and didn’t want the noise associated with fence installation to disturb it. The woman explained that she would be happy to keep the noise to a minimum, and could wait until they were out of the house to erect the fence.
However, the man still wasn’t happy with this proposition, asking why the woman needed a fence in the first place. “I said it’s nothing personal, but I’m putting up a shed, and I just don’t want his kids coming onto my property and getting hurt”, she explained.
One day, the woman spotted an opportunity. “I came home from work and saw the family loading bags into their car”, she recounted. “The car was gone for a few days, so I figured they’d gone away for the weekend, and as they were worried about me disturbing their baby, now was the perfect time.”
Building the Fence
Excited to finally have her opportunity, the woman got to work. She specifically built the fence to ensure that it didn’t encroach onto her neighbor’s property or break any council rules.
However, upon the neighbor’s return, the couple was met with a complaint. “The husband wants me to get rid of the fence”, she lamented. “He says it’s an eyesore and he’s worried his kids will get injured on it.”
However, the woman firmly protected her fence. “I tell him it’s on my property and it’s staying”, she continued “He says he should have been consulted because it’s surrounding his property and his wife thinks it’s ugly.”
Legal vs. Moral Dilemma
From a legal standpoint, the woman knew that she was within her rights to install the fence on her property. However, she questioned whether she had been inconsiderate to brush away her neighbors’ concerns, who were clearly very upset.
However, the woman ultimately decided that she did nothing wrong. The couple had planned to start a family and had plans for their yard, so they couldn’t just let their neighbors walk all over them.
